At that time, I was working for a multi billion dollar company where over a million people are employed. The HR department was not ready to serve any individual cases. Moreover the job prospectus were not great there at that time. It was always on the limbo. In fact, I did process another EB2 case in 2006. I got the I-140 Approval on that after the first one. And my employer's Immigration Department did not agree for a switch even after I pleaded to them. It was really hard luck. I spent over 18000.00 dollars to get that EB2 one which went down the drain. What to do? Its just fate. Finally the much awaited SMS/e-mail came through (from TSC). My guess is USCIS (TSC/NSC/etc) is approving cases at random as long as PD is current. There is no logic to Filing date / Notice date and all that. I came on F-1 10 years back (08/03/00) and was current for 2 months in 08 with no luck..... Please be patient... I know it is been frustating after a long wait and at times to see GC get approved for folks with later PD and all that after all we are humans and feel why someone was choosen today and not me ...... hang in there and I wish u all get that magic e-mail..... BTW, today I treid calling USCIS. First the 1st level representative spoke and she straightway created a SR for me and my daughter. Once she finished that part Politely I asked her to transfer to an IO. Luckily without any wait call got connected to an IO. Had very brief conversation with him. He was fixated on my EAD being valid till August 2010, so according to him I don't have to worry about. But I persisted with my line of questions like current status, whether it is pre-adjudicated?, whether all clearances are done etc. Only thing he replied was "Your Case is in REVIEW". I asked him what does review means. His answer was review means review. Our conversation stopped there. I am on OPT expiring soon.. My employer filed for H1 and got approved for oct 1st. I will be out of status for sometime so I plan to go on H4( I am married) . Now one lawyer told me that If I apply for H4 my H1 approval will become invalid and I will have to reapply for H1. i.e if I do not have I 94 attached to the approval ( however I just got approval notification . no documents received yet , so no way to know if i have I 94 attached) Another Lawyer said thats not the case. He said I can go on H4 with a validity till If we don't fix the backlogs then age out will be irrelevant.
